Frequently Asked Questions

Answers to common questions about HR management in Saudi Arabia

Saudization (Nitaqat) requirements vary based on company size and industry sector. Companies are classified into different color categories (Platinum, Green, Yellow, Red) based on their Saudization percentage. The required percentage typically ranges from 5% to 100% depending on the sector. Meeting these requirements is essential for obtaining and renewing business licenses, work permits, and other government services. Our HR team can provide specific guidance based on your company's size and industry.

Employment contracts in Saudi Arabia must include: the employer and employee names and addresses, salary and benefits, job title and duties, contract duration (limited or unlimited term), probation period (if applicable), working hours, leave entitlements, and termination conditions. Contracts must be in Arabic (with translations if needed) and provided in duplicate, with one copy for each party. All employment contracts must comply with Saudi Labor Law provisions regarding minimum standards for working conditions, benefits, and employee rights.

The process begins with obtaining a work visa (also called an employment visa) from the Ministry of Foreign Affairs through Saudi embassies abroad. Once the employee arrives in Saudi Arabia, they must complete several procedures including: medical examination, obtaining a residency permit (Iqama), registration with the General Organization for Social Insurance (GOSI), and opening a local bank account. The employer is responsible for sponsoring the employee throughout this process. Our HR services can manage this entire process on your behalf to ensure compliance and efficiency.

Employees in Saudi Arabia are entitled to: annual leave (21 days per year, increasing to 30 days after 5 years of service); sick leave (up to 120 days per year with varying pay rates); maternity leave (10 weeks with full pay for female employees with at least one year of service); paternity leave (3 days); bereavement leave (typically 3-5 days); and Hajj leave (10-15 days once during employment). Additionally, employees are entitled to paid holidays for Eid Al-Fitr, Eid Al-Adha, and Saudi National Day. These entitlements are minimum requirements under Saudi Labor Law.

End-of-service benefits (ESB) or gratuity is mandatory for all employees upon termination of employment. For unlimited contracts, employees are entitled to: half-month's salary for each of the first five years of service and one month's salary for each subsequent year. For limited contracts, if the employer terminates the contract, the employee is entitled to the remaining contract value or regular ESB, whichever is higher. ESB is calculated based on the last basic salary and is payable even if the employee resigns, though at a reduced rate if resignation occurs before completing five years of service.
